Deployment of ITS officers in BSNL on BSNL posts: SNEA(I),
BSNLEU and AIBSNLEA jointly filed petition in the PCAT, New Delhi
praying “declare that the Impugned Order dated 11.03.2013, issued by DoT tantamount
to non-compliance of the Orders dated 17.04.2012, 15.02.2013 and
04.03.2013 passed by the Hon’ble High Court of Delhi in WP No.
22515/2005”.
01-04-2013 It is
very pathetic and unprecedented to find Unethical Vendors being
allowed to provide the Call Center Services in both CFA & CMTS wing
resulting in total failure and chaos en route.In Odisha Circle, the
CFA Call Center was being operated by VMC of Hyderabad & the Wireless
Services Call Center was operated by M/s Sparsh BPO Services. VMC
stopped the service on 7th Feb 2013 and M/s Sparsh terminated the
services abruptly on 14th Mar 2013, Reason was the invoice placed by
M/s Sparsh was in violation of the EOI & was objected with
recalculation resulting in decrease of the amount claimed in the
invoice. Locally the Call Center people were agreeing to our logic and
calculation, but at their corporate level, they are demanding the
EXACT CLAIMED AMOUNT. In Odisha for WS CC, we have converted all the
PRIs to E1 to make it CDR compatible. The Company is not honoring the
intervention of the hon'ble Court of Bhubaneswar, who has refrained
the company from suspending CC Services. We have met our CGM today
(along with Com P K Sahoo, CP, Com M K Nayak, Treasurer) and had

Writ
petition 1803/2013 filed jointly by SNEA(I), BSNLEU and AIBSNLEA praying
for quashing the order of DoT dated 11.3.2013 to deploy unabsorbed ITS
to BSNL came up for hearing in the Hon Delhi HC. Hon HC while
maintaining that the order of DoT dated 11.3.2013 is a clear
infringement of the judgment of the Hon HC in WP 22515/2005 and CM
16683/2013(Application filed by SNEA(I), BSNLEU and AIBSNLEA), however
advised the applicants to move applications seeking similar relief at
appropriate forum. Hon bench during the course of argument observed that
passing any order in the instant writ petition might prejudice contempt
proceedings already initiated by the Hon Delhi High Court. We
engaged Senior Advocate Sri. Neeraj Kaul and heated arguments took
place. UOI represented by Addl Solicitor General and BSNL by Sr Advocte
Sri. V. K. Rao. We will be taking further course of action in the coming
days.

CONTEMPT NOTICE TO RESPONDENTS AND FURTHER POSTED ON 25-07-2013.

of ITS repatriation CaseAdditional Solicitor General (ASG), UOI again moved an application
before the Hon'ble Bench to reconsider the judgment of dismissal of the
application filed by UOI (DOT) today morning. Hon'ble
High Court again called the concerned Advocates and after hearing the
arguments, adhere to its judgment of dismissal of the application
pronounced in the morning.

REPATRIATION ISSUEDOT filed a fresh application in Hon. High Court of Delhi
last week praying before the Hon. High Court that DOT will comply with
the direction of the Hon HC to
end deemed deputation of ITS by repatriating them from BSNL / MTNL to
DOT. The application further prayed that DOT in compliance to the
decision of the Union Cabinet may be permitted to send repatriated ITS back
to BSNL / MTNL on deputation for a period of 10 years in a diminishing
manner.This
application of DOT came up for hearing today in the Hon. High Court of
Delhi and the application was summarily dismissed. Hon.
High Court directed DOT to respect the law of the land and comply with
the direction of Delhi High
Court.

with DIR(HR): President,
GS and Com M Gopinathan, CS/TN Circle met Sri A N Rai, DIR(HR) on
22.02.’13 and discussed:
a) Sending
reply to DOT on 78.2% IDA merger: DIR(HR)
informed that he cleared the reply on 20.02.’13 itself and got the
approval of CMD in the same day evening before he leaving the office for
foreign tour. We thanked him for the prompt action. Assn met CMD on
20.02.’13 and requested for expeditious actions to send the reply to
DOT.
b) Filling
up of all the 2700 vacant STS posts instead of 760 posts: Assn
informed DIR(HR) about the discussions with CMD, BSNL on 22.02.’13 on
this issue. We explained that approval is given only for the 760 posts
lying vacant in the 50% regular promotion quota. All the 2632 posts in
the 50% STS quota for MTs are lying vacant today and BSNL Mgt proposed
to recruit only 500 MTs, remaining 2132 STS posts has to be filled on
Adhoc basis as per BSNLMS RR. Now SDEs promoted in 1994 and 1998
completed 18 and 14 years and waiting for their promotion. Major reasons
for court cases are the undue delay in getting promotions and if Mgt is
giving promotion to all the vacant posts, we will be able to promote
almost all the senior officers promoted upto 1998. DIR(HR) responded
very positively and informed us that Mgt will try to promote maximum
officers.
c) JTO
to SDE promotion under seniority and LDCE quota: We
informed DIR(HR) that the JTO to SDE DPC is work is moving very slow
and requested his intervention. Even after 8 months the assessment
report not received from most of the Circles. JTOs of 1995 batch and
completed 16 years of service are waiting for their first promotion.
DIR(HR) informed that suitable action will be taken and specific date
will be fixed for the Circles. On ongoing case at PCAT on LDCE, Assn
requested DIR(HR), proper action to see that BSNL lawyer is taking
keen interest and argument is taking place in the next date in March.
DIR(HR) informed that the delay was caused as the applicants in the
transferred cases has to be given minimum time to file the reply and
without reply, argument on the merit of the case cannot take place.
Some salient features contained in the Cabinet decision
on absorption of ITS Group “A” in BSNL/MTNL:
Comrades, as reported by us in the last CWC meeting at Chennai on 07th and
08th January,
2013, the Cabinet memo contains the following proposals:
-
a) Group
“A” Absorption process in BSNL/MTNL stands concluded which in effect
means that the seniority of the absorbed ITS is delinked from those
who would, according to the note, continue on deputation for a fixed
time frame. (This undoubtedly paves the way for promotion of absorbed
ITS against BSNL posts as CGMs/GMs/DGMs etc).
-
b) All
the BSNL posts have to be filled up by absorbed officers to the extent
absorbed officers are available on priority basis.(ITS
who are to continue on deputation in BSNL/MTNL in accordance to terms
and conditions of the Cabinet decision will not be eligible for
consideration for promotions against BSNL posts hereinafter. That
in essence means that absorbed and eligible JAG will get promotion to
SAG and eligible SAG will get promotion as HAG, overriding seniority
of those ITS who would be on deputation but are otherwise eligible for
promotion in all respects).

c) Govt
fully empowers BSNL/MTNL to make recruitment to top Management posts
which remain unfilled after promotion of eligible absorbed officers.
This recruitment would be allowed under provisions of Rule 37which
envisages that unabsorbed ITS would be also eligible to be recruited
in BSNL/MTNL afresh after they get their pension and retirement
benefits from Govt. for the service rendered by them in DOT. Their
countdown for seniority in the respective cadres they are recruited in
BSNL shall start ab-initio. They will be eligible for further
promotions in BSNL.

d) BSNL/MTNL
is allowed to retain the unabsorbed ITS officers on deputation
(BSNL-941 and MTNL-83) for a maximum period of 10 years in a
diminishing manner ie 10% will be repatriated/retired every year (Majority
of repatriation on a year to year basis is from the DGM cadre and
retirement from CGM/GM cadre). In MTNL, repatriation will be completed
in 3 years time. However,
these 941 & 83 unabsorbed ITS on deputation in BSNL/MTNL and about 400
repatriated officers would be eligible for promotion against only 65
posts at HAG/SAG level in DOT which is already filled up (Total DOT
posts-463: Advisor / HAG-04, CGM / HAG-05, GM/SAG-56, DGM/JAG-100,
STS-280, JTS-18).DOT
will be conducting cadre review.
-
e) The deemed
deputation period from 2005 also stands regularised.
Comrades, first three provisions cited above, except fourth one, and
contained in the Cabinet decision address comprehensively our concerns
in so far as our persistent and fundamental demand that BSNL should be
led by a management belonging to the Company and posts of BSNL should be
earmarked exclusively for absorbed people. These provisions have been
included in the Cabinet decision because of strenuous and sustained
efforts of the Association and the Joint Forum. Tireless efforts of the
Association in the form of consistent and endless interactions with the
bureaucracy in DOT and extensive and invaluable inputs that it gave to
the concerned officers in DOT dealing with absorption process
facilitated and enabled bureaucracy in DOT to include critical and
significant provisions in the Cabinet note. The three provisions cited
above and contained in the Cabinet decision is a landmark breakthrough
as these three core provisions meet our critical concerns
comprehensively and the concerns of the Company as well.
We have no words to congratulate our base level
membership throughout the Country for their unstinted, unqualified and
total support and huge patience that alone helped and enabled us to get
these critical provisions included in the Cabinet decision to fully
safeguard our career growth in BSNL as well as the growth of the
Company. We
also take this opportunity to assure our Comrades that whatever adverse
provisions are contained in the Cabinet decision that affect us or
growth of the Company in any manner would be fought tooth and nail
legally. There
would be absolutely no let up in our sustained fight to safeguard our
legitimate interests and those of the Company.
This decision of the Cabinet dated 13.02.2013 finally lay
to rest the issue of absorption of ITS in BSNL/MTNL. However, to know
the finer and elaborate contents of the Cabinet decision, minutes of the
Cabinet meeting are being awaited.

order to mitigate the learning difficulties for officers who are of 55
years and above age on the date of their respective up-gradation order,
they will have the option of undergoing one week Refresher Course
as a part of the mandatory training under EPP followed by appearing in
online exam at the respective Training Centre. The options from
such willing officers would be compiled by the respective CGMs and
forwarded to the RTTCs so as to enable them to schedule and conduct
refresher courses for such executives. In the case of, Corporate Office,
the options from such officers would be compiled by respective staff
branches and forwarded to ALTTC for conduct of course

Update on
Various Court Cases:
Update in the case regarding ITS: The
case came up for hearing in Hon. High Court of Delhi on 15/2/13. It is
learnt that case was dismissed and the court directed to implement its
earlier order within 6 weeks time.
Update on in WP 16102/11 & WP 26246/11 in Hon. Chennai High
Court regarding JTO to SDE roster case: The
case came up for hearing on 14th February 2013 and has been posted for
27/2/2013.
Update on SLP no. 35756/2012 regarding regarding 25 % competitive
qualified candidates. The
SLP was filed by BSNL and others Vs S. Sadasivam & ANR and was admitted
in Hon'ble Supreme Court against the similar judgements given by two
High courts namely Kerala and Maharashtra which were against 25 %
competitive quota. The similar case presently under Punjab high court is
likely to be shifted to Honorable Supreme Court and there is a
likelihood that all these cases will be clubbed together for hearing on
18/3/2013. Department has been instructed to file a reply in this
regard.
Update on SLP no. 1517/2013 regarding qualified candidates in the exam
held in the year 2003: The
SLP filed in the above mentioned matter has been admitted in Supreme
Court on 28/1/13. The next hearing in the matter is 14/4/13. Honorable
court has directed the department to file reply after 30 days of listing
of the case or two weeks prior to the date of next hearing.
Update on stay at STS Promotion in Chennai
CAT: The
case regarding stay on STS promotion came for hearing on 7th Feb 2013 at
Chennai CAT. The hearing is further postponed to 18th Feb 2013. Further
posted to 21/2/13.
Update on case at Ernakulam High court
regarding 147: The
hearings in the case are over. Judgment has been reserved.
Meeting
with Sri K C G K Pillai, DIR(Fin), BSNL Board:
GS Com K. Sebastin and AGS Com Arvind Pal Dahiya met Sri K C G K Pillai,
DIR(Fin) on 14.02.2013 and discussed
a)
78.2% IDA merger w.e.f 01.01.2007:
Assn sought the intervention of DIR(Fin) for the early resolution of
this issue. DIR(F) assured that BSNL will retain its earlier stand that
the additional expenditure can be met by the internal resources and
honour the agreement with the Unions/Associations. Accordingly file is
cleared by the Finance wing. Assn will be meeting CMD and DIR(HR) on
this issue next week.
b)
Centralised payment of EPF contribution to JTOs/JAOs directly recruited
by BSNL:
Discussions held in continuation to the deliberations held in the
Chennai CWC meeting on 07th and 08thJan ’13 in
which DIR(Fin) also attended. We explained that due to the
non-resolution of this issue, EPF A/C of thousands of Executives
especially those who are transferred from one station to another station
are not maintained properly and even the updated balance sheet is not
getting. We also suggested that as demanded in the CWC, centralized EPF
payment is the only solution for this. After detailed discussion DIR(Fin)
informed that as per the deliberations in the Chennai CWC, the issue is
under serious consideration of the BSNL Management and file is already
under process. The issue will be further discussed with the DIR(HR).Comrades,
Assn will take all the efforts to see that this long pending issue is
resolved at the earliest.
c) Proposal to reduce DGM and DE posts and the proceedings of the
remuneration committee:
After brief discussion DIR(F) informed that the proposal of reduction of
DGM post is under the active consideration of the Committee and DE post
is not come up for consideration so far. He promised to further discuss
the issue next week.
ITS REPATRIATION CASE
DISMISSED
BY HON. HIGH COURT OF DELHI.
Congrats! Hon’ble High Court out rightly dismissed the plea of BSNL
management to allow ITS to continue on deputation in BSNL and directed
BSNL Management / DOT to implement its order to repatriate unabsorbed
ITS within six weeks.Tireless
efforts of our association along with AIBSNLEA and BSNLEU have borne
fruit. Continue to have enormous faith in the mechanism of struggle.
Comrades your tremendous support and faith have given us strength to
fight and we assure you that with your complete support we will fight
out this issue to the last drop of our blood.

Important decisions taken by the
Central Working Committee meeting of SNEA(I) held
at Chennai on 7thand 8th of
Jan 2013.
1. CWC unanimously decided that the ongoing struggle on the
issue of ITS repatriation and building a top management for BSNL
should continue along with other Unions and Associations representing
the Non Executives and Executives.Simultaneously the Association has
to continue the legal fight against this issue.
2. Considering the undue delay in the resolution of recent LDCE
related case, the CWC meeting unanimously decided that SNEA(I) has to
implead in the LDCE case in the Hon. PCAT New Delhi to have an
expeditious resolution of the case.
3. The CWC meeting reviewed the Court cases in which our
association become a party like MT Case, BSNL MSRR case, Different
cases related to seniority ( JTO seniority, 270 seniority case / 147
seniority case / 1966 reversion case), NCSC case, Illegal 3G roaming
case, ITS repatriation case etc and also reviewed the huge expenditure
incurred for the same.Considering
the huge legal expenditure, the CWC unanimously decided to make
separate Legal Fund andeach
member has to contribute Rs.200/- (Rupees Two hundred) towards
this Legal fund.

Working Committee meeting of SNEA(India) held at Chennai on 07th and
08th January, 2013 in respect
of Cadre issues:
1. Finalization
of standard pay scales of JTOs of 2007 & 2008 batches, JAOs
and executives recruited after 01-01-2007.
2. Centralised
payment of EPF of directly recruited Executives.
3.Immediate finalization of the
recommendations of the committee constituted to finalize the time bound
functional promotion or CPSU cadre hierarchy and standard pay scales of
E2, E3 etc.
4. Regularization
of officiating JTOs as a onetime measure.
5. Expedite
the recruitment to the cadre of JTOs against 50% dept quota from amongst
the eligible candidates as per JTO R/Rs.
6. Immediate
filling up of all the SDE, DE, and DGM posts. Efforts to be made to
settle all the court cases including LDCE to enable expeditious issuing
of functional promotions to TES Gr B, STS and adhoc JAG.
7. Pay
anomalies to be settled at the earliest. Pay anomalies in respect of Non
executives are already settled as per the Hon Supreme Court order. In
the case of Executives also, Hon Kerala CAT and High Court have already
directed BSNL to settle the pay anomaly. There cannot be different
criteria for the employees of the same company.
Hon.PCAT
NewDelhi delivered an important judgement in Management Trainee RR case
filed by the Association
Hon. PCAT NewDelhi declared that
the restriction on age and qualification for internal candidates in the
MT RR is arbitrary and discriminatory and directed the authorities to
revise the MT RR accordingly.
Further the Hon. Court directed
that the ongoing MT recruitment process should be completed as per the
interim direction given by the Hon. Ernakulam CAT (i.e) without age and
qualification restriction.
This is a great victory for the
stand taken by this Association,
that the restriction of age and qualification in MT RR is discriminatory
and the same is now vindicated by this judgement.
Originally our Association
challenged the MT RR at Hon. Ernakulam CAT and got provisional
admission, later on the case has been transferred to Hon. PCAT NewDelhi.
The Association is fighting this case along with AIBSNLEA at Hon.PCAT,
NewDelhi.
